Terms & Conditions
1. Agreement and scope
These terms apply to driving instructor training, coaching and mentoring provided by Parisa’s Driving School (“we”, “us”, “the School”) to the person booking (“you”, “trainee”), whether delivered in person, in a vehicle, or online. They form part of the agreement alongside your written booking confirmation and training plan. Nothing here affects statutory consumer rights.
2. Services
Training may include ADI Part 1 theory and hazard perception preparation; Part 2 driving ability; Part 3 instructional ability; PDI development and mentoring; ADI Standards Check preparation; CPD; lesson planning; mock assessments; and online workshops. The scope, number of hours, method of delivery and any included materials will be specified at booking. Additional training requires your agreement before any extra fee is charged.
3. Booking
A booking is confirmed when we accept it and any agreed advance payment is received. Dates are subject to availability. We will tell you the total price, duration, delivery method and any additional charges before you commit. You must provide accurate contact details and relevant information needed for safe delivery.
4. Fees and payment
Training may be purchased per session or as a prepaid package. Prices and any applicable VAT will be stated before booking. Individual sessions are payable [insert deadline] before the session unless agreed otherwise. Package payments or instalments follow the written schedule. DVSA fees, re-tests, travel and other expenses are excluded unless expressly included. We may pause future training for overdue payments after reasonable notice.
5. Trainee cancellations and rescheduling
Please give at least 48 hours’ notice to cancel or move a session. With that notice, you may rearrange without an administration fee, subject to availability. With less notice or non-attendance, we may charge only a fair amount reflecting actual reasonably foreseeable loss, costs saved and opportunities to fill the slot; the full fee is not automatically forfeited. We will consider illness, emergencies and exceptional circumstances fairly. Statutory cancellation rights take precedence.
6. Cancellations by the School
If we cancel due to illness, vehicle problems, unsafe weather or another delivery issue, we will offer a reasonable replacement appointment or refund the affected undelivered session. If a material disruption prevents delivery of a package within a reasonable time, you may be entitled to terminate the affected services and receive an appropriate refund. We do not charge you for our cancellation.
7. Prepaid packages and unused hours
Package contents, price, discount and expiry will be confirmed in writing. Our proposed standard validity is 12 months from purchase, subject to the agreed booking terms and statutory rights. We will consider reasonable extensions for illness, disability, unavoidable events or lack of our availability. If you end a package early, any refund will fairly account for training supplied and reasonable recoverable loss. We do not automatically keep the value of unused training; any disclosed discount adjustment must be fair and proportionate.
8. Distance and off-premises cancellation rights
For a qualifying consumer service contract made online, by telephone or away from business premises, you normally have 14 days from contract formation to cancel without giving a reason. Tell us clearly by email or post; the optional form in Appendix A can be used. Where training has not started, payments are normally refunded in full. If you expressly ask us to start during this period and then cancel, a proportionate charge may apply for services supplied, provided legal requirements have been met. If the service is fully performed following the necessary express request and acknowledgement, the right to cancel that completed service may end. Refunds due under these rights will be made within the applicable legal time limit, normally 14 days after notification.
9. In-person practical training
Practical sessions may use our vehicle or yours, as agreed. You must have the appropriate valid driving licence. A trainee-supplied vehicle must be roadworthy, lawful, suitable and insured for the actual training activity. We will confirm conditions and insurance for any School-supplied vehicle. Insurance excess or damage responsibility must be separately disclosed and agreed; you are not automatically liable for every loss. Follow lawful safety directions. We may stop unsafe activity. Do not drive impaired by alcohol, drugs or medication.
10. Online training
Online sessions may use Zoom, Teams, Meet or an agreed alternative. You should have a suitable device, connection and quiet setting. Both parties will make reasonable efforts to resolve technical problems. Material disruption caused by our systems will be rescheduled or refunded; problems at your end will be assessed fairly, including possible rearrangement. No participant may record, broadcast or redistribute a session without appropriate permission. Online teaching does not replace practical training required by DVSA rules.
11. Attendance and trainee responsibilities
Attend punctually, participate professionally, complete agreed preparation and respect trainers, pupils and other trainees. Maintain any licences, permissions and insurance required for your activities. You are responsible for DVSA applications, test bookings and deadlines unless we expressly agree otherwise. You must not give paid driving instruction unless legally authorised.
12. DVSA examinations and outcomes
We provide preparation and constructive feedback but cannot guarantee a pass in ADI Parts 1, 2 or 3, a Standards Check grade, a trainee licence or ADI registration. DVSA decides examination outcomes and eligibility. DVSA fees and re-test fees are separate unless included in writing. Any recommended additional training will be separately priced and agreed.
13. PDI licence training
A PDI trainee must comply with current DVSA licence conditions. We will identify which agreed training and records are intended to meet DVSA requirements and accurately complete records or declarations that form part of our contracted service. Purchasing a package does not itself confer eligibility for a trainee licence, its renewal or extension.
14. Qualified ADI development
Standards Check preparation may include observed lessons, mock assessments, feedback, lesson planning and risk management. Unless otherwise agreed, you arrange any suitable pupil needed for an official assessment. Our mock assessment is not an official DVSA grade. Qualified ADIs remain responsible for their registration and professional compliance.
15. Materials and intellectual property
Training materials we create remain our intellectual property unless otherwise agreed. You may use supplied resources personally for study and professional development, but must not resell, publish, upload or distribute them without written permission. Any time-limited access to online resources will be clearly specified before purchase.
16. Privacy and confidentiality
We process personal data for bookings, payments, training delivery, progress records and lawful administration in line with applicable UK data protection law. Our separate Privacy Notice will explain retention, lawful bases, sharing and individual rights. Do not share identifiable pupil or trainee information or recordings without an appropriate lawful basis and any required permission.
17. Behaviour and inclusion
We expect respectful conduct and do not tolerate harassment, discrimination, threats or abuse. We will consider reasonable adjustments for disability. We may suspend unsafe or seriously inappropriate conduct, explaining concerns where practicable. Any termination and refund will be assessed fairly under law.
18. Safety and safeguarding
We prioritise the safety of trainees, trainers, pupils and road users. Report incidents promptly. We may change or stop exercises where safety requires it. Where a trainee is under 18, appropriate parent/guardian involvement and safeguarding arrangements are required.
19. Liability
We will provide services with reasonable care and skill. Nothing excludes liability for death or personal injury caused by negligence, fraud or any liability that cannot lawfully be excluded. Failure to achieve an exam result alone does not establish that training was defective. Accident and vehicle-damage liability depends on the circumstances, insurance and law; no automatic blanket transfer of liability applies.
20. Events beyond reasonable control
Where severe weather, emergencies or other events beyond reasonable control prevent training, we will notify you promptly and try to rearrange. If delivery becomes impossible or unreasonably delayed, any right to end the affected service and receive an appropriate refund remains available.
21. Complaints
Please send complaints to parisabearman@yahoo.co.uk. We aim to acknowledge within five working days and give a substantive reply within 14 working days, or explain if further investigation is needed. You retain all legal rights and available remedies.
22. Changes to these terms
Updated terms apply to future bookings. The terms agreed for an existing booking remain in force unless a lawful change is mutually agreed or required by law. Material changes will be explained in advance.
23. Governing law
These terms are governed by the law of England and Wales, subject to mandatory consumer protections and any applicable rights concerning court jurisdiction.
24. Acceptance
By confirming a booking after receiving these terms, you agree to the contractual terms, subject to statutory rights. Any request to begin within the 14-day statutory cancellation period must be obtained separately where applicable.
